Worker Labor Rights in New York

Derechos Laborales del Trabajador en New York

According to New York worker labor rights, through its Department of Labor, employers are required to fill out a form before employees begin working, which includes detailed information about wages and employers, including the headquarters or principal place of business, and their main phone number.

In accordance with Article 195.1 of the Organizational Labor Law, this is mandatory. As of 2012, employers must send this form to all employees no later than February 1 of each year.

Some of the rights you have as a worker in New York are…

Written Notification

New employees must receive written notice of the employer's job details before starting work. The form must be signed and dated by both the employer and employee, and the employer must retain it for at least six years. New York state labor law requires that a copy of this notice, form LS 56, be sent to employees at the time they begin working.

Salary

The state of New York requires that employers clearly indicate how employees will be paid. This includes hourly, daily, weekly, or monthly rates. If it is a weekly salary or wage, the employer must indicate how many hours will be covered. In the state of New York, employers are not allowed to pay by the hour to non-exempt employees in the hospitality sector (such as hotels), but these people are not individuals who earn income through sales commissions.

Deductions

New York state labor laws require that employers explain any deductions (if any) taken from employee salaries. These may include tips, meals, lodging, or other conditions that must be specified.

Pay Periods

Employers must notify employees all the days of the week they will receive salaries. Additionally, the employer must describe the employee's salary frequency, that is, whether it will be paid weekly, every two weeks, monthly, or through other arrangements.

Overtime

When employees work more than 40 hours a week, they must receive overtime pay. New York labor law requires that the rate be equal to or greater than 1.5 times the employee's hourly wage. Professionals and agricultural workers are among the few occupations in the state of New York where overtime pay does not apply.

Discrimination

As in other states, in New York City it is illegal for employers to discriminate against employees based on their nationality, sexual orientation, gender, or other aspects protected by New York City's Human Rights Law.

It is illegal to refuse to hire or fire people who work in the country without permission. However, because of the employee's immigration status, it is against city and state laws for employers to pay below minimum wage or refuse to comply with overtime pay rules. Employers should not treat employees differently by paying lower wages than other workers or because of their immigration status, among other things, because they do not have documents.

Just like these, you have many other rights protected by the New York State Labor Law. If you believe that any of them has been disrespected, you should contact Conexión Legal immediately by phone or through WhatsApp so that a labor attorney specialized in the area can help you take your case and thus be able to ensure that you receive the highest possible compensation.
