If Social Security Said No, You Have 60 Days to Appeal

Most disability applications are denied the first time, often because medical reports are missing, not because the person doesn't qualify. A denial letter doesn't close your case: first you ask for reconsideration and, if that's denied too, a hearing before a judge. But each step has a 60-day deadline from the day you get the letter. If you miss it, you usually have to start over and can lose months of back pay.

That's why we answer right away: you call or write, a person answers in Spanish within minutes, and your case is reviewed in less than 24 hours, with the exact date your deadline runs out. If you qualify, the lawyer requests your medical records and prepares the appeal before the deadline passes.

Questions People Ask Us Before They Call

‍

"I was denied disability. Is it worth appealing?"

Yes, in many cases. At the hearing with the judge you explain your situation in person, and new medical evidence can be submitted. It's the stage where the most cases are approved, and arriving well prepared makes the difference.

"I don't have money for a lawyer."

You don't need it. In Social Security cases, fees are set by law: 25% of the back pay you're approved for, up to a maximum of $9,200, and Social Security has to authorize them. If your benefits aren't approved, you don't pay fees.

"I don't have papers. Can I apply for Social Security?"

To collect Social Security benefits you need lawful immigration status, and the rules change depending on the program and the type of permit. If you were hurt in an accident or at work, there are other paths that protect you regardless of your papers, such as workers' compensation or a personal injury claim. The consultation is confidential, and we tell you which path works for you.

"I got hurt at work and I already receive workers' compensation."

You can still apply for SSDI if the injury will keep you from working for a year or more. Social Security may reduce your payment so the two benefits combined don't exceed 80% of what you earned before. We review how to combine them so you receive the most.

"Do I have to stop working completely?"

Not always, but there's a limit. In 2026, if you earn more than $1,690 a month, Social Security considers that you can work and denies the benefit. Before taking on extra hours, it's worth checking with us.

Applying for disability for the first time?

We prepare your SSDI or SSI application with the medical and work records Social Security needs to see, so the first review has everything it asks for.

Was your application denied?

We file the reconsideration within the 60 days and strengthen what was missing: reports from your doctors, tests, and evidence of how your condition limits your work.

If you were hurt at work, in a crash, or in a fall, besides Social Security there may be a workers' compensation claim or a lawsuit against whoever was responsible. We review every option in the same consultation: work injuries and personal injury.

We Help Across the United States

Social Security rules are federal, so they're the same across the country. What changes from state to state is the office that reviews your case and how long the hearing takes.

California

Los Angeles, the Inland Empire, the Central Valley, and the whole state. In California, SSI includes a state payment on top of the federal one.

Georgia

Atlanta, Augusta, Savannah, and the rest of the state.

Illinois

Chicago and the counties of Cook, DuPage, Kane, and Lake.

New York, New Jersey, and Pennsylvania

We also review Social Security cases in these three states.

Your state isn't listed? We can still review your case. Call 800 201 1220.

What Social Security Law Says About Your Case

‍

There are two programs: SSDI and SSI

SSDI (Social Security Disability Insurance) is for people who worked and paid Social Security taxes long enough. SSI (Supplemental Security Income) is for people with low income and few assets, even if they have no work history. In 2026, the maximum federal SSI payment is $994 a month per person.

What counts as a disability

A physical or mental condition that keeps you from working for at least 12 months, or that is expected to result in death. Also, you can't be earning more than $1,690 a month (2026 figure).

60 days at every stage

Application, reconsideration, hearing before a judge, Appeals Council, and federal court. After each decision you have 60 days to move to the next stage.

SSDI has a five-month waiting period

The first payment is for the sixth full month of disability. If the case takes a while, Social Security owes you back pay from that date, which is why it matters that the application is filed correctly from the start.
