In San Diego, If the Trolley, a Bus or the City Is Responsible, You Only Have Six Months

San Diego has a lot of public transit and many streets managed by the government. The MTS trolley and buses, City of San Diego streets and the freeways maintained by Caltrans all belong to public entities. If a bus hit your car, you fell getting off the trolley, or you crashed because of a pothole or a broken traffic light, California law gives you only 6 months from the injury to file a written claim with that entity. Only after that can you file the personal injury lawsuit. If you miss that deadline, the case becomes much harder, even if fault was clear.

And serious crashes are not rare in the city. The City of San Diego runs Vision Zero, its official program to reduce deaths and serious injuries from crashes on its streets.

What People Ask Us Most Before Calling

‍

"I don't have papers. Can I file a claim?"

Yes. Workers' compensation and personal injury lawsuits in California protect you regardless of your immigration status. The consultation is confidential, and no one will ask you for papers to review your case.

"I got hurt on a construction site and my employer says they don't have insurance."

There are still options. In California, your employer has to give you the claim form (DWC-1) within one business day of learning about the injury, and if they truly don't have insurance, there are other avenues. The lawyer who reviews your case will explain which one applies.

"The insurance company already called me and wants me to sign."

Don't sign anything yet. The first offer usually comes before you know how much your recovery will cost, and accepting it normally closes the claim.

"I don't have the police report."

You can request it later. If the crash happened in the city, the report is made by the San Diego Police Department; on the freeways, usually by the CHP. Also, when someone was injured, each driver has to report the crash to the DMV with the SR-1 form within 10 days.

"Who pays the doctor in the meantime?"

If you were hurt at work, your employer's insurance company has to authorize treatment within one business day after you turn in the claim form, up to $10,000 while it investigates. If it was a crash, there are options to get treated now and pay from the outcome of the case.

What California Law Says About Your Case in San Diego

‍

Two years, or just six months

In California, you have 2 years from the injury to file a personal injury lawsuit, and 3 years if there was only property damage. If the responsible party is a government entity, such as the MTS or the City of San Diego, you first have to file a claim within 6 months.

You can recover even if you were partly at fault

In a personal injury case, California uses pure comparative fault: if you were 20% at fault, you can still recover 80% of the compensation. The insurance company will try to raise your percentage, so it's best not to talk about the accident without legal advice.

Minimum insurance is $30,000 per person

Since 2025, every driver in California must carry at least $30,000 per injured person, $60,000 per accident and $15,000 for property damage. When injuries are serious, that minimum falls short, and sometimes your own uninsured motorist (UM) coverage can pay the difference.

At work, 30 days to report

Tell your employer as soon as possible, and always within 30 days. Ask for the DWC-1 form; your employer has one business day to give it to you.
