Serious health problems can be devastating in various ways for families. If a member of any family becomes seriously ill due to some type of medical negligence, issues such as job loss or loss of income, loss of health insurance, and inability to pay medical bills, all can have a negative impact on the family. Furthermore, the parent or spouse who is in charge of the sick family member may experience their own problems by leaving employment and obtaining health insurance for the family when insurance coverage has ended, and making financial decisions that involve the compromised clinical future of the sick person can be a heavy burden. Finally, matters related to health care that involve pregnancy and childbirth can have implications for the family, as well, in terms of health insurance coverage and job abandonment.

What Does the Law Indicate?
If you or your spouse have access to health insurance funded by your employer for your work or your spouse's work, you are part of federal law. ERISA must provide specific information about your health insurance plan, such as coverage limits, costs, and rules you must follow. ERISA also expects you to be informed about the appeals process against the rejection of your health care request that you have submitted for yourself and/or your family. For families covered by insurance plans such as a cancer diagnosis, the Health Insurance Portability and Accountability Act ("HIPAA") prohibits insurance companies from discriminating against you in any way. For example, health insurance coverage should not charge sick people different premiums or rates than healthy people, reject treatment coverage, or exclude them from health insurance coverage.Similarly, if you are ill or do not meet certain health standards, your health insurance coverage should not prohibit you from obtaining health insurance. Similarly, HIPAA requires that your health insurance plan offer the additional option of enrolling in the plan or receiving compensation if certain circumstances change, such as: If during your marriage, divorce, or if you give birth to or adopt a child, and your spouse with health insurance dies, or if you lose coverage from another insurance (spouse) through employment. HIPAA also grants certain legal rights related to Covered Services.HIPAA has modified ERISA to limit the exclusion of pre-existing medical conditions or medical conditions that have been treated in any way during the six months prior to your employer's health insurance plan. Although many insurance policies exclude coverage for treatments related to pre-existing medical conditions, HIPAA limits the cutoff period for pre-existing medical conditions to 12 months and other types of health care received during that time. I ask that you prove your insurance coverage regardless of whether they are cases of medical negligence.
12-Month Period
If you lose your health insurance because you lost your job, or can no longer work many hours due to your illness caused or not caused by medical negligence, or the illness of a family member, you have some rights to maintain coverage of your current health insurance under the Consolidated Omnibus Budget Reconciliation Act ("COBRA"). COBRA applies to all employers with 20 or more employees, and requires that you be able to purchase health insurance through your former employer at the same price for up to the following 18 months after loss of your employment.
Although it can be costly to maintain medical coverage under COBRA because you must pay your employer's portion of your insurance premium, along with your own share of that premium payment, it will still typically be cheaper than trying to purchase a private insurance policy.
