The Fair Labor Standards Act (FLSA) establishes guidelines for minimum wage, overtime pay, record keeping, and child employment. These labor law standards in the United States affect the private sector and the federal government, as well as state and local governments for full-time and part-time workers.

The Wage and Hour Division (WHD) of the United States Department of Labor (DOL) administers and enforces the FLSA among private employment departments, state and local government departments, and federal employees of the Library of Congress, the United States Postal Service, the Postal Rate Commission, and the Tennessee Valley Authority.

As for employees of other federal government executive agencies, the United States Office of Personnel Management, and the United States Congress enforce the law against employees within the scope of the legislative power law.

Certain special rules apply to employees of state, local, and government departments, involving fire extinction activities, law enforcement activities, volunteer services, and the granting of vacation time in lieu of overtime pay in cash.

Workers under the scope of the law and not exempt are entitled to a minimum wage of $7.25 per hour since its implementation on July 24, 2009. Special provisions apply to workers in American Samoa and in the Commonwealth of the Northern Mariana Islands. Non-exempt workers must be paid overtime at a rate of at least time and a half of their regular pay rate after 40 hours of work in a workweek.

The Fair Labor Standards Act requires that wages be paid on the normal payday of the pay period. If deductions are made from wages due to insufficient wages or funds, the cost of purchasing uniforms and commercial tools required by the employer is illegal. If these deductions reduce the employee's wages below the minimum wage required by the FLSA or if the regulations of this be reduced overtime pay.

The FLSA contains some exemptions to these basic rules. Some are suited for specific businesses, while others are suited for specific jobs.

Although the "Foreign Labor Law" stipulates minimum wage, basic standards for overtime pay, and regulates child employment, there are still some labor practices that are not regulated by law.

For example, the Fair Labor Standards Act does not require:

  • Pay for vacations, holidays, termination of employment, or illness.
  • Meal or rest periods, holidays, or vacations.
  • Additional pay for working weekends or holidays.
  • Salary increases or supplemental benefits.
  • Notice of dismissal, reason for dismissal, or immediate payment of the last paycheck.

The FLSA does not require wage payment nor does it provide means to recover normal or promised wages to the employee or commissions that exceed what the Law requires.

However, some states have laws under which such claims can be made (and in some cases, supplemental benefits).

Furthermore, the Fair Labor Standards Act also does not limit the number of hours an employee can be required to work per day or the number of days in a week, including overtime hours, if the employee is at least 16 years of age.
